Terms and Conditions – Hiett Benefits

1. Overview

These Terms and Conditions (“Terms”) govern your use of SMS/text messaging services (the “SMS Program”) offered by Hiett Benefits, formerly known as Hiett Insurance (“Hiett Benefits,” “we,” “us,” or “our”). By enrolling in or using our SMS Program, you agree to these Terms.

2. Program Description

Hiett Benefits uses SMS messages to communicate with clients and prospects about insurance and employee benefits services, including: appointment reminders, policy or plan updates, enrollment information, renewal notices, service alerts, and customer support messages. We may also send occasional educational content and limited promotional messages related to our insurance and benefits services, if you have provided the appropriate consent.

3. Consent and Opt-In

You will only receive SMS messages from us if you voluntarily opt in, for example by submitting a web form, texting a keyword to our number, signing a consent form, or requesting SMS communication from us.

By opting in, you confirm that you are the authorized user of the mobile number provided and that you are at least 18 years old (or have the consent of a parent/guardian if applicable).

Your consent to receive SMS messages is not a condition of purchasing any insurance or benefits products or services from us.

4. Message Frequency

Message frequency may vary based on your interaction with us, your active policies or benefits plans, and the specific programs you enroll in, but in general you can expect:

Service and transactional messages as needed for your account (e.g., reminders, confirmations, updates).

Occasional educational or promotional messages if you opted into marketing messages.

If you feel you are receiving too many messages, you can opt out at any time as described below.

5. Message and Data Rates

Message and data rates may apply to each SMS message sent or received, as determined by your mobile carrier’s plan. You are responsible for any charges imposed by your mobile carrier. Check your mobile plan for details.

6. Opt-Out Instructions (STOP)

You can opt out of receiving SMS messages from us at any time:

Text STOP to the number from which you received messages.

After you send STOP, we may send a confirmation text to verify your opt-out, and then you will no longer receive messages from that program.

You can also contact us using the information below to request removal from our SMS list.

Opting out of SMS messages will not affect your ability to receive other forms of communication from us (such as email or phone calls), unless you separately opt out of those channels.

8. Participating Carriers

Delivery of SMS messages is subject to effective transmission by your mobile carrier and is not guaranteed. Supported carriers may change at any time, and messages may not be available on all carriers or in all areas.

9. Privacy

10. Eligibility and Geographic Scope

The SMS Program is intended for individuals located in the United States using U.S.-based mobile phone numbers. By participating, you represent that you meet these criteria.

11. Your Responsibilities

You agree to:

Provide accurate and up-to-date contact information.

Notify us promptly if you change or deactivate your mobile number.

Not enroll a number that you do not own or control.

12. Disclaimers and Limitation of Liability

SMS messages may be delayed or not delivered due to factors outside our control, including carrier issues, network problems, device compatibility, or incorrect information provided by you. We are not liable for any delays, failures, or misdirected deliveries of any messages.

SMS messages may not include all information or disclosures relating to your insurance policies or benefits plans. You should not rely solely on SMS messages for important coverage or legal information, and you should review your policy documents, plan materials, and official correspondence.

To the maximum extent permitted by law, Hiett Benefits will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your participation in the SMS Program.

13. Changes to These Terms or the SMS Program

We may modify these Terms or the SMS Program at any time, for example to comply with legal or carrier requirements or to improve our services. If we make material changes, we will update the “Last updated” date and may provide additional notice as required. Your continued participation in the SMS Program after changes are posted constitutes your acceptance of the revised Terms.

14. Termination

We may suspend or discontinue the SMS Program, or your individual access to it, at any time and for any reason, including suspected misuse, fraud, non-compliance with these Terms, or technical or operational changes.

15. Governing Law

These Terms and your use of the SMS Program are governed by the laws of the State of Illinois (without regard to conflict of law principles), except to the extent preempted by federal law.
